“We”, “Our”, “Ourselves” and “Us” Means Aer Arann Islands
“You”, “Your” and “Yourself” Means any person, except members of the crew, carried or to be carried in an aircraft with our consent (See also definition of passenger)
Additional Services Means any products and services purchased by and which by third party providers i.e., bus or coach transfers.
Baggage Means your personal property accompanying you in connection with your trip. Unless otherwise specified. It includes both your checked and unchecked baggage.
Booking Means a booking made by you for the purchase of a flight and which is accepted by us in accordance with these general conditions of carriage.
Booking References Means the number you are given by us to identify each on-line flight reservation made by you and confirmed by us.
Carrier Means Aer Arann Islands
Convention Means whichever of the following instruments are applicable: Warsaw convention 1929
The Warsaw Convention 1929, as amended at the Hague 1955 and by the additional protocol No. 4 of Montreal 1975.
The Montreal Convention 1999, Convention for the unification of certain rules for international carriage by air as supplemented by the Guadalajara Convention 1961 where applicable.
Damage Includes death, wounding or bodily injury to a passenger and loss, partial loss or theft or other damage to baggage of whatsoever nature arising out of or in connection with carriage performed by us.
Days Means calendar days, including all seven days of the week; for the purpose of notification, the day upon which notice is dispatched shall not be counted.
EC Regulation Means Council Regulation 2027/97 on air carrier liability in the event of accidents as amended by the European Parliament and Council Regulation 889/2002.
Fare Means the amount paid or to be paid for the relevant flight.
Flight Means a single flight from one airport to another.
General Conditions of Carriage Means these terms and conditions governing your booking, published by us and in effect from time to time.
Journey Means a single flight from one airport to another airport.
Passenger Means any person, except members of crew, carried or to be carried in an aircraft with our consent (see also definition for “you”, “your” and “yourself”
Special Drawing Right Is a unit fluctuating in value by reference to a basket of major currencies used in international trade and finance as determined by the International monetary Fund. It is used to fix, from time to time a Sterling or other currency equivalent.
Tarif Means the Fares, Rates, Charges, and conditions applicable thereto.
Ticket Means the confirmation of flight details and (including the booking reference) together with the general conditions of carriage and important notices issued by us or on our behalf (whether in the form of a confirmation letter or equivalent information on the website) and the boarding pass issued at check – in.
Unchecked Baggage Means all personal items taken onboard by a passenger and any baggage other than checked baggage. Alternatively referred to as “hand luggage”

Flight Cancellations, Rerouting, Schedule Changes and Weather
If your flight is rescheduled by more than thirty minutes earlier or later than the original flight time, we will endeavour to contact you or your authorized agent (via phone, email, or SMS) through the contact details provided at the time of booking. The flight times shown in timetables may change between the date of publication and the date you travel. We do not guarantee them to you, and they do not form part of your contract with us.
Our schedule is subject to change without notice.
If the time change is greater than two hours, and this is unsuitable to you, all monies including taxes will be refunded in full. For further details on how to claim your refund please refer to section 4 herein.
If we cancel any flight, we will endeavour to contact you in advance (via phone, email, or SMS) through the contact details provided at the time of booking. We shall act in accordance with the Montreal Convention and EC REGULATION 261/2004 will carry you at the earliest opportunity on another of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of your ticket or;
Within a reasonable period re-route you to the destination shown on your ticket by our own services or those of another carrier, or by mutually agreed means and class of transportation without additional charge or;
- Make a refund in accordance with the provisions of Article 4.
- Save as provided for in law, when a flight is cancelled, the above options are the sole and exclusive remedies available to you and we shall have no further liability to you. Notwithstanding the foregoing, we shall not be liable to you for any loss or damage occasioned by such cancellation.
- The remedies mentioned in this Article will be available to you at our discretion, if we have taken all reasonably necessary measure to avoid the damage or it was impossible for us to take such measures.
We will take all necessary measures to avoid delay in carrying you and your baggage. However, if your flight is delayed, we may, if reasonably practicable, endeavour to contact you (via phone, email, or SMS) through the contact details provided at the time of booking.
In the event your flight is delayed more than 5 hours and you chose not to travel, a refund can be claimed for the part or parts of the journey not made.
To prevent a flight cancellation, we may arrange for a flight to be operated on our behalf by an alternative carrier and/or aircraft.
Aer Arann Islands will employ its best efforts to carry passengers and baggage to the destination shown on your ticket. If adverse weather, or to conform with other operational requirements we may, without notice, divert to an alternative airport. To discharge our contractual obligation, it may be necessary to offer an alternative onward flight with another air carrier or overland transportation.
Reservations and Changes
The evidence of the contract of carriage is the ticket. The ticket, these terms and conditions and other additional conditions (including applicable tariffs) together constitute the terms and conditions of the contract of carriage between you and us.
We also vend tickets for a transfer service operating from various destination airports served by us to local drop off points. This is a stand-alone service and constitutes a separate contractual obligation by us to you. Nothing in these terms and conditions shall give rise to any cause or action or remedy in respect of bus journeys. We vend these tickets as a separate service and not as a component part of any package as defined under EC Council Directive 90/314.
If you miss your flight your ticket is no longer valid. No refund is available if you miss your flight.
You shall not be entitled to be carried on a flight unless you present a valid ticket containing the flight coupon for that flight. In addition, you shall not be entitled to be carried if the ticket presented is mutilated or if it has been altered otherwise than by us or our authorized agent. It is your responsibility to take all appropriate measures to safeguard your ticket and ensure it is not or stolen.
We may use the personal data that have provided for the purpose of:
- Making a reservation and issuing a ticket
- Providing you with your travel and any other ancillary services which you wish to avail of.
- Accounting, billing, and auditing
- Verification of credit or other charge cards
- Immigration security and customs control
- Statistical analysis
For these purposes we may transmit your data to:
- Our own offices
- Our authorised agents
- Government agencies
- Credit and Charge card companies
- Data processing companies working on our behalf.
Some of these companies/entities may be located outside the European Union.
Your data will only be used in relation to this contract of carriage or as required by law. You may apply for a copy of any data or information held by us subject to payment of a reasonable administration fee. Representations should be made in writing and accompanied by a payment of €20 to Aer Arann Islands.
Refunds are made solely at our discretion. Save as otherwise provided for in these terms and conditions or under international, European, or national law. All refund requests and queries must be made in writing at least 24 hours prior to the scheduled time of departure of your flight, via email to [email protected] or post to the refunds department, Aer Aran islands, Indreabhan, Galway Ireland. Unless otherwise advised all refunds will be in the mode of the original form of payments
In any event you will not be entitled to a refund in the event of illness, whether foreseen or not.
If we are required by law to levy any charge independent of those imposed be Aer Arann Islands, we will collect said charges by the same method of payment that you used initially. We will make all reasonable endeavours, save where you have omitted to provide us with contact details to ensure that you are notified of any additional charges prior to collection.
Infants and Young Persons
Carriage of Infants
Infants under the age of two years may fly on Aer Arann Islands flights provided that they sit on an adult’s lap. If an infant reaches the age of two years prior to the return journey they may pay the fare applicable to that part of the journey.
Unaccompanied Minors (UMS) AND young persons (YPS)
Aer Arann Islands will accept unaccompanied children under the age of 12 years of age for travel. An unaccompanied minor form must be filled out prior to departure. To this end we strongly advise that you allow sufficient time, in addition to that specified in section 6, to ensure all of the relevant paperwork is completed.
Check-In and Boarding Information
Aer Arann Islands recommends that passengers check in at least 30 minutes prior to the scheduled departure. Check in closes 20 minutes prior to the schedule departure time. Failure to travel or check in on time will result in your full booking being cancelled. By completing the check in process, we man submitting any baggage for hold stowage and obtaining a boarding card.
Aer Arann Islands requires that all checked baggage be clearly identifiable with your name and address and contact numbers. Failure to comply with this requirement may result in a significant delay in the delivery of your baggage should it be misplaced. If your bag is delayed or damaged any claim arising will be subject to the provisions and limitations of the Montreal Convention 1999 and/or as reflected in Regulation EC No. 889/2002. Details of these limits can be found in section 11. Passengers are advised to familiarize themselves with these conditions prior to travel on an Aer Arann Islands flight. You should also ensure that you have suitable private insurance cover for your journey. Certain items are not permitted for carriage in checked or unchecked baggage. These are listed below under the details of Dangerous Articles in Baggage.
In addition to these conditions, Aer Arann islands also has the following baggage policy:
During normal handling, your luggage may show signs of wear and tear. Aer Arann Islands accepts no responsibility for such minor cuts, scratches, and dents, save where integrity and or functionality of the bag is compromised.
Aer Arann islands does not accept responsibility for any damage caused to or because of damage caused to the following items:
- Items of fragile nature such as musical, sporting or of perishable nature.
- Over packed bags.
- Loss of external locks, zips, pull straps or security straps.
- Manufacturers defects.
- Baggage containing valuable items.
Passengers should ensure that fragile items, including but not limited to sports equipment, musical instruments, computers, laptops, art, and infant equipment etc should be adequately protected in a hard shell or robust container suitable to protect the item while being handled and stowed. Should the item deemed to be unsuitable packaged we can refuse to accept carriage of said item. Any consequential losses arising from any said refusal shall be your responsibility.
Please note therefore, that any minor damage to such items which does not affect the functionality (i.e.: working order) of the item in question will not be compensated for, as the passenger will be deemed to have accepted the risk that such minor damage can and may occur. These items are only carried on a limited release basis (i.e., entirely at your own risk, for loss, damage, or delay) You should therefore ensure that you have suitable private insurance cover for your journey.
Aer Arann Islands accepts no responsibility for any items that are considered to be either valuable or by their very nature unsuitable for carriage by air. Such items include but are not confined to money, electrical equipment, jewellery, fragile or perishable items, important documentation, and medication.
Any claims for damaged contents either due to an inherent vice of the packaged container or due to unsuitable packaging may result in us being wholly or partially exonerated from our liability.
14kgs per passenger on all flights. The maximum total weight for any one piece of checked baggage is 14kgs with maximum dimensions that are not excessive so as to render them impossible for safe carriage onboard our aircraft.
Infant Baggage weight allowance: Nil
Stroller / Buggy allowance: 1 piece per infant booked.
We will make all reasonable endeavours to make sure that your baggage is carried on the same flight as you. On occasions, weight or size restrictions or other operational factors may prevent us from doing so. A failure to carry your baggage on the same flight as you, for the aforementioned reasons, will not give rise to any compensatory claim against us unless provide for in law.
Infant equipment including but not limited to prams, buggies, cots and car seats are considered to be inherently unsuitable for carriage by air, unless suitably packed (See 7 (B). It is possible to carry such equipment as checked baggage and such items will be loaded in the same manner as all other items of baggage. Aer Arann Islands is prepared to carry such items subject to the items in question being packed with appropriate diligence as outlined in section 7 (B) Failure to do so may result in us being wholly or partially exonerated from our liability to you. You should therefore ensure that you have suitable private insurance cover for your journey. Only 1 piece of infant equipment is permitted per infant booked.
Please not that damage to infant equipment that does not affect functionality (i.e., working order) of the item in question will not be compensated for as the passenger is deemed to accept such minor damage can occur to such items in transit.
Cabin Baggage Allowance
One piece of cabin baggage is permitted per passenger. It must not weigh more than 2kg and must be small enough not to obstruct the exits. Passengers should carry all medication and any important documentation such as passports and/or money in their cabin baggage.
Excess baggage may be accepted if space is available. If not, every effort will be made to send the items on the next available flight. We reserve the right to charge a fee for this service, details of which can be obtained from our reservation’s office or airport representatives.

Carriage of assistance dogs and pets
Assistance dogs accompanying passengers with disabilities will be carried free of charge in addition to the normal free baggage allowance. The airline must be advised at time of booking and at least 48 hours in advance of travel.
Carriage of pets is permitted subject to availability of space. The airline must be advised at time of booking and at least 48 hours in advance of travel. Pets must be contained in a crate, which is escape proof, leak proof and of sufficient size to allow the pet to stand up, turn around and lie down fully stretched. Dogs can be accepted without a crate if they are fully muzzled.
Carriage of pets, excluding assistance dogs is on a space available basis only. A pet, excluding assistance dogs may be refused travel up to and including the scheduled departure time.
Where carriage is not subject to the liability rules of the Convention, we are not responsible for injury to or loss, sickness, or death of an animal, which we have agreed to carry unless we have been negligent.
Large, delicate musical instruments that exceed our cabin baggage dimensions may be carried in the cabin if a seat has been reserved and the appropriate fare paid. Aer Arann Islands is prepared to carry such items subject to the items in question being packed with appropriate diligence as outlined in section 7b. Failure to do so may result in us being wholly or partially exonerated from our liability to you. You should therefore ensure that you have suitable private insurance cover for your journey.
The carriage of out of gauge baggage such as sporting equipment can be checked in as normal. If, due to additional space restrictions such out of gauge baggage cannot travel on the flight, it will be carried on the next service where space is available and can be collected by the passenger at the destination airport upon arrival there.
Aer Arann Islands is prepared to carry such items subject to the items in question being packed with appropriate diligence as outlined in section 7b. Failure to do so may result in us being wholly or partially exonerated from our liability to you. You should therefore ensure that you have suitable private insurance cover for your journey.
Sporting Weapons / Firearms
Aer Aran Islands permits the carriage of weapons, firearms, or ammunition only in exceptional circumstances. Carriage is subject to concordance with bot national and international laws and notification to the carrier at the time of booking. We explicitly reserve the right to withdraw our permission in the event we are required to do so either, on the grounds of safety or to comply with our obligations in law.
Dangerous articles in baggage
For safety reasons, dangerous articles such as those listed below, must not be carried in passenger cabin, or hold baggage. Compressed gases, (deeply refrigerated, flammable, non-flammable and poisonous) such as butane, oxygen, liquid nitrogen, aqualung cylinders and compressed gas cylinders; items with internal combustion engines such as chain saws, model aircraft and lawnmowers. Corrosives such as acids, alkalis, wet cell batteries and items containing mercury (e.g., thermometers) and chlorine. Explosives, munitions, ammunition including blank cartridges, handguns, shot guns, fireworks, Christmas crackers, flares, and pistol caps. Flammable liquids and solids such as lighters that need inverting before ignition, lighter fuel, matches (Safety matches may be carried on the person), firelighters, paints, and thinners.
Radioactive materials, oxidizing materials such as bleaching powder and peroxides. Poisons and infectious substance such as insecticides, weed killers and live virus materials. Brief cases and attaché cases with installed alarm devices. Other dangerous articles such as magnetised material, offensive or irritating materials.
Medicines and toiletries in limited quantities required by the passenger during the journey such as hair spray, perfumes and medicines may be carried.
Guns, Firearms and weapons or any object capable, or appearing to be capable of discharging a projectile or causing injury, including all firearms (pistols, revolvers, and shotguns etc.) Replica and imitation firearms, component parts of firearm (excluding telescopic sighting devices and sights) Air pistols, rifles and pellet guns. Signal flare pistols, starter pistol, toy guns of all types. Ball bearing guns, industrial bolt and nail guns, crossbows and arrows, catapults, harpoon and spear guns, animal humane killers, stun, or shocking devices, e.g., cattle prods, ballistic conducted energy weapons (lasers, Lighters shaped like a firearm, ice axes and picks, open razors, and blades (excluding disposable and safety razors with blades enclosed in cartridges).
Explosives, flammable substances, any explosive, or highly combustible substances which pose a risk to the health of the passengers and crew or the security and safety of aircraft and property including ammunition, blasting caps, detonators and fuses, explosives and explosive devices, replica or imitation explosive material or devices, mines and other explosive military stores, grenades of all types. Gas and gas containers e.g., butane, propane, acetylene, oxygen in large volume. Fireworks, flares in any form and other pyrotechnics (including party poopers and toy caps). Non safety matches, smoke generating cannisters or cartridges. Flammable liquid fuel, e.g., petrol, gas, diesel, lighter fuel, alcohol, ethanol, aerosol spray paint, turpentine and paint thinner, alcoholic beverages exceeding 70% by volume (140% proof)
Chemicals and toxic substances: any chemical or toxic substances that pose a risk to the health of passengers and crew or passengers or the security and safety of property, including disabling or incapacitating sprays, e.g., mace pepper spray, tear gas, radioactive material, e.g., medicinal, or commercial isotopes, poisons, infectious or biological hazardous material, e.g., infected blood, bacteria, and viruses. Material capable of spontaneous ignition or combustion, fire extinguishers.
Explosives, including detonators, fuses, grenades, mines, and explosives. Gases including propane, butane, flammable liquids, including gasoline, methanol. Flammable solids and reactive substances including magnesium firelighters, fireworks, flares, oxidisers, and organic peroxides, including bleach, car body repair kits. Toxic or infectious substances, including rat poison, infected blood, radioactive material, including medicinal or commercial isotopes. Corrosives, including mercury, vehicle batteries. Vehicle fuel system components that have contained fuel.
In addition to the items listed under dangerous articles the following items will not be accepted for carriage in the cabin but can be accepted in the hold once suitably packed.
Acceptance for carriage of incapacitated persons, pregnant women, persons with illness or other people requiring special assistance is subject to the provisions of EC regulation 1107/2006. To avoid any delay in carriage passengers are required to notify the airline 48 hours before their departure. Passengers with disabilities who have advised us of any special requirements at the time of booking and have been accepted by us shall not subsequently be refused carriage based on such disability or special requirements, save as required to comply with either legal obligations or the terms of our operating license.
Medication and wheelchair assistance
Passengers requiring medication for any condition must ensure that they keep enough upon their person for the duration of each flight and possible delays.
Aer Aran Islands or the relevant airport authorities will provide wheelchair facilities free of charge to any passenger requiring assistance. Passengers are required to advise the airline 48 hours in advance of travel. Failure to do so may cause a delay in the delivery of this service.
It is the responsibility of pregnant passengers to Advise Aer Arann Islands of their condition at time of booking.
During the last four weeks of pregnancy prior to confinement (which is normally from the 36th week of pregnancy) an expectant mother shall only be accepted for carriage with a letter of consent from the local doctor or nurse.
Passengers who require the use of oxygen during the flight may be permitted to carry a small oxygen cylinder onboard, unless in our reasonable judgement we assess it is not safe to do so. Carriage of oxygen is subject to verification from a medical practitioner that the oxygen is vital to sustaining your health and well-being in flight.
Any passenger wishing to carry oxygen onboard the aircraft must notify the carrier at the time of booking or at least 48 hours before the time of departure.
Conduct aboard the Aircraft.
Smoking is prohibited onboard the aircraft. Consumption of alcohol is prohibited onboard the aircraft.
For safety reasons we may limit or forbid or limit operation onboard the aircraft of electronic equipment, including but not limited to cellular phones, laptops, computers, portable recorders, transmitting devices, radio-controlled toys or walkie Talkies, CD players, I Pods or other similar items, electronic games devices and portable radios.
Operation of hearing aids and heart pacemakers is permitted.
If you conduct yourself onboard the aircraft so as to endanger the aircraft or any person or property onboard, or obstruct the crew in performance of their duties, or fail to comply with any instructions of the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew we may take such measures as we deem reasonably necessary to prevent continuation of such conduct, including restrain. You may be disembarked and refused onward carriage at any point and reported to the relevant authorities with a view to having you prosecuted for any criminal offences committed onboard the aircraft.
If, because of your behaviour we divert the aircraft for the purposes of offloading you, you must pay us the costs of the diversion and any fines and penalties imposed by the government of the country to which we have diverted.
Right to refuse Carriage
We may refuse to carry you or your baggage if we have notified you in writing that we would not at any time after the date of such notice carry you on our flight. In this circumstance you will be entitled to a refund.
We may also refuse to carry you or your baggage if one or more of the following occurred or we believe may occur:
- Such action as necessary to comply with any applicable government laws, regulations or orders.
- The carriage of you or your baggage may endanger or effect the safety of the aircraft, or the safety, health, comfort of other passengers or crew.
- Your mental or physical state, including impairment from alcohol or drugs presents a hazard or risk to yourself, to passengers, to crew or to property.
- You have committed misconduct on a previous flight and/or we have reason to believe that such misconduct may be repeated.
- You have refused to submit you or your baggage to a security check.
- You have not paid the applicable fare, taxes, fees, or charges.
- You owe us money in respect of a previous flight owing to payment having been dishonest, denied or recharged against us.
- You do not appear to have valid travel documents, may seek to enter a country through which you may have been in transit, or for which you do not have valid travel documents, destroy your travel documents during flight, refuse to surrender your travel documents to the flight crew, against receipt, when so requested or refuse to allow us to photocopy your travel documents.
- You presented a ticket that has been acquired unlawfully, has been purchased from an entity other than us or an authorised agent, or has been reported as being lost or stolen, is counterfeit, or you cannot prove that you are the person named in the ticket.
- If you failed to comply with our instructions with respect to safety or security.
- You have used threatening, abusive, or insulting words towards our ground staff or crew of the aircraft or acted in an intimidating manner.
- You have deliberately interfered with a member of the crew of the aircraft carrying out their duties.
- You have made a hoax threat relating to bombs, biological or chemical weapons.
- You have put the safety of either the aircraft or any person in danger.
- You have committed a criminal offence during the check in or boarding process or onboard the aircraft.
- If we have refused to carry you based on any of the above or have removed you en route we may cancel the remaining unused portion of your ticket and you will not be entitled to further carriage or to a refund in respect of the sector (s) covered by the ticket. With prejudice to the incumbent obligations and liabilities of an air carrier under European regulations of the Convention, we will not be liable for any consequential loss or damage alleged due to any such refusal to carry or your removal enroute.
Conditions of Contract and Limits to Liability
- Carriage hereunder is subject to the rules and limitations relating to liability established by the conventions, pursuant to EC regulations and given full force of law by the Air Navigation and Transport Act 2004
- To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (1) provisions contained in the ticket. (2) Applicable tariffs. (3) carriers’ conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of the carrier.
- Carrier’s name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier’s tariffs, conditions of carriage, regulations, or timetables. The carrier’s address shall be the airport of departure shown opposite the first abbreviation of carrier’s name in the ticket. The agreed stopping places set forth in this ticket or as shown in the carrier’s timetable as scheduled stopping places on the passenger’s route: carriage to be performed hereunder by several successive carriers is regarded as a single operation.
- An air carrier issuing a ticket for carriage over the lines of another carrier does so only as a disclosed agent.
- Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants, and representatives.
- No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract. Carriage is subject to the above conditions of contract and to the Aer Arann Islands conditions of carriage.
- Unless contrary mechanisms exist in law, if the air carrier can prove that the damage was caused by, or contributed to by, the negligence of the injured or deceased passenger the air carrier may be exonerated wholly or partly from its liability in accordance with applicable law.
- The following information is provided in accordance with regulation 889/2002 but it cannot be used as a basis for any claim for compensation nor to interpret the provisions of that regulation or particular convention.
Air carrier liability for passengers and their baggage
This information notice summarises the liability rules applied by Community air carriers as required by Community legislation and Montreal convention.
Compensation in the case of death or injury
There are no financial limits to the liability for passenger injury or death. For damages up to 113,100 SDRs (approximately €126,950) the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.
If a passenger is killed or injured, the air carrier must make an advance payment to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16000 (approximately €20,000).
In the case of passenger delays, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage, or it was impossible to take such measures. The liability for passenger delays is limited to 4,694 SDR’S (approximately €5,250)
In the case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage, or it was impossible to take such measures. The liability for baggage delay is limited to 1,131 SDR’S (approximately €1,250)
Destruction, loss or damage to baggage.
The air carrier is liable for destruction, loss, or damage to baggage up to 1,131 SDRs (approximately €1,250). In the case of checked baggage, it is liable even if it is not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if it is at fault.
Higher Limits for Baggage
A passenger can benefit from a higher liability by making a special declaration at the latest at check-in and by paying a supplementary fee.
Complaints on Baggage
If the baggage is damaged, delayed, lost, or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked in baggage, the passenger must write and complain within seven days, and in the case of delay within twenty-one days.
Liability of Contracting and Actual Carriers
If the air carrier performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting carrier.

The basis for the rules described above is the Montreal Convention of 28th May 1999, which is implemented in the Community by regulation EC 2027/97 as amended by regulation EC 889/2002 and national legislation of member states.
Choice of Law and Jurisdiction
Unless otherwise provided by the Convention or any applicable law, Government regulation, orders, or requirements:
- These terms and conditions and any carriage which we agree to provide you with (In respect of yourself and your baggage) shall be governed by the laws of the Republic of Ireland.
- Any dispute between you and us concerning or arising out of carriage in any way whatsoever shall be the subject to the non-exclusive jurisdiction of the courts of the republic of Ireland.
